1. Acceptance of these Terms

These Terms of Service (“Terms”) govern your access to and use of MachineryDocs (“the Service”), available at app.machinerydocs.shop. By purchasing a subscription or accessing the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

MachineryDocs is a platform providing online access to a library of technical manuals, operator guides and parts catalogs for agricultural and heavy machinery, in PDF format (“User Content”), including documents uploaded by independent contributors. The catalog is open to everyone: anyone may browse it and view a short preview (limited to the first pages) of each document without an account. Subscribers can read complete documents online without limits and download a limited number of PDF files per calendar month, according to their plan (currently 25 downloads/month on the Monthly plan and 45 downloads/month on the Annual plan). Subscription fees are charged for platform access, hosting and account services, not for any specific document; no part of subscription revenue is derived from or linked to any individual item of User Content. Content availability is not guaranteed: documents may be added, updated or removed at any time, including for legal reasons, without entitling users to refunds or compensation.

3. Accounts

Browsing the catalog and viewing document previews require no account. A free account lets you upload documents and rate them. Reading complete documents and downloading files require an active paid subscription.

When you purchase a subscription, an account is created automatically and login credentials are sent to the email address used at checkout. You are responsible for keeping your credentials confidential. Accounts are personal and non-transferable: sharing your login with other people, workshops or companies is not permitted and may result in suspension or termination of access without refund.

4. Subscriptions, billing and refunds

Payments are processed by Stripe, our payment provider. Subscriptions renew automatically (monthly or yearly, depending on your plan) until canceled. You can change your plan, update your payment method or cancel at any time through the subscription portal available on your Account page. All purchases are covered by a 7-day money-back guarantee. If you cancel, your access continues until the end of the period already paid. After a refund or chargeback, access ends immediately. We never store your credit card details.

5. Acceptable use

You agree to use the Service only for lawful reference purposes. You must not:

• redistribute, resell, publish or share the documents or your access to them;
• use bots, scripts or automated tools to scrape or mass-download content;
• circumvent, or attempt to circumvent, download limits or security measures;
• use the Service in any way that violates applicable law.

Violation of this section may result in immediate suspension or termination of your account, without refund, in addition to any remedies available by law.

6. User Content and uploads

Any registered user (including free accounts) may upload documents to be published in the library (“Contributors”). By uploading, you represent and warrant that you are the lawful owner or authorized licensee of the material and that it does not infringe any copyright, trademark, contractual right, privacy right or other third-party right. You grant MachineryDocs a worldwide, royalty-free, sublicensable license to host, store, reproduce, display and make the material available to subscribers for as long as it remains on the platform.

MachineryDocs does not pre-screen uploads and does not review, verify or approve User Content prior to publication. We do not and cannot verify the copyright status, accuracy or legality of User Content. All legal responsibility for uploaded material rests exclusively with the Contributor who uploaded it. Moderation is reactive: content is removed in response to valid copyright notices and rule violations.

You agree to indemnify, defend and hold harmless MachineryDocs, its owners and contractors from any claims, damages, penalties, losses or legal fees arising from your uploads, including copyright or intellectual property claims, misrepresentation of ownership, or breach of this Agreement. In the event of a takedown notice or legal complaint relating to your uploads, you agree to cooperate fully and promptly.

MachineryDocs may remove, disable or permanently delete any User Content at its sole discretion and without notice, including content subject to complaint, suspected infringement or breach of platform rules. Accounts of repeat infringers are suspended or terminated (see our DMCA Policy). MachineryDocs is not a storage or backup service: Contributors are solely responsible for keeping their own copies of uploaded files.

7. Intellectual property and DMCA

The manuals and catalogs available through the Service are technical documentation related to products of their respective manufacturers. All product names, brand names, logos and trademarks mentioned in the documents or on this website are the property of their respective owners. MachineryDocs is an independent documentation platform and is not affiliated with, endorsed by, or sponsored by any machinery manufacturer.MachineryDocs does not claim ownership of User Content and acts as a hosting platform for material uploaded by contributors.

If you are a rights holder and believe any content available through the Service infringes your rights, submit a takedown notice through our DMCA Policy page (or email primosnegocios2@gmail.com). We act expeditiously on valid notices, remove or disable access to the identified material, and enforce a repeat infringer policy.

8. Disclaimer: use at your own risk

The documents are provided for reference purposes, “as is” and “as available”, without warranties of any kind, including accuracy, completeness or fitness for a particular purpose. Servicing and operating machinery involves risk. Always follow the safety instructions of the equipment manufacturer and applicable regulations. MachineryDocs is not responsible for personal injury, equipment damage or any losses arising from the use of the information contained in the documents.

9. Limitation of liability

To the maximum extent permitted by law, the total liability of MachineryDocs for any claims arising out of or related to the Service is limited to the amount you paid for your subscription in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special or consequential damages.

10. Availability and changes

We work to keep the Service available at all times, but we do not guarantee uninterrupted availability. The library content may change over time (documents may be added, updated or removed). We may update these Terms; material changes will be posted on this page with a new “Last updated” date. Continued use of the Service after changes constitutes acceptance.

11. Governing law

These Terms are governed by the laws of Brazil, where MachineryDocs is operated, without prejudice to mandatory consumer protections of the country where you reside.
